DMCA & Takedown Policy

1. Overview
CastProof is deeply committed to protecting the likeness rights of every Model on our platform and respecting the intellectual property of all parties. We take unauthorized use of likenesses and copyrighted material extremely seriously.
Our platform is built on the principle that Models own their likeness and should have full control over how it is used. Every generation is watermarked, every license is auditable, and every misuse is actionable. If you believe your likeness or copyrighted work has been used without authorization — whether on or off our platform — we are here to help.
2. How to Report Unauthorized Use
If you believe your likeness or copyrighted material has been used without your consent, follow these steps:
- Identify the Content. Locate the specific content you believe infringes on your rights. Take screenshots and note URLs where the content appears.
- Gather Documentation. Prepare evidence of your ownership — this may include your CastProof Model profile, original likeness assets, or copyright registration.
- Submit a Takedown Request. Send your request to dmca@castproof.com with the required information outlined in Section 3 below.
- Await Confirmation. You will receive an acknowledgment within 2 business days. Our team will review your request and take action within 5 business days.
3. Required Information for Takedown Requests
Your takedown request must include the following information to be processed:
- Your full legal name and contact information (email address, mailing address, phone number).
- A description of the copyrighted work or likeness you claim has been infringed.
- The URL(s) or other specific identification of the allegedly infringing content on our platform or elsewhere.
- A statement that you have a good-faith belief that the use of the material is not authorized by the rights owner, its agent, or the law.
- A statement, under penalty of perjury, that the information in your notice is accurate and that you are the rights owner or authorized to act on the owner's behalf.
- Your physical or electronic signature.
- If applicable, the CastProof watermark ID or generation ID associated with the content.
4. Watermark Verification
Every piece of content generated through CastProof is embedded with an invisible digital watermark. This watermark system is a core part of our enforcement infrastructure:
- Provenance Tracking. Each watermark encodes a unique generation ID, linking the content to the specific license, Creator, and Model involved.
- Tamper Resistance. Our watermarks are designed to survive common transformations such as cropping, compression, and format conversion.
- Verification Tool. Models and rights holders can use our watermark verification tool to check whether a piece of content was generated through CastProof and to retrieve the associated license details.
- External Enforcement. If CastProof-watermarked content appears outside the scope of its approved license, we will assist with enforcement actions including takedown requests to third-party platforms.
5. Investigation Process
Upon receiving a valid takedown request, CastProof will:
- Acknowledge Receipt. Confirm receipt of the request within 2 business days.
- Investigate. Review the reported content, verify watermark data, and check license records to determine whether the use was authorized.
- Take Action. If the content is determined to be unauthorized, we will promptly remove or disable access to the infringing content, notify the accused party, and document the violation.
- Notify Parties. Both the complainant and the accused party will be notified of the outcome of the investigation.
6. Counter-Notification Process
If you believe your content was removed in error, you may submit a counter-notification to dmca@castproof.com including:
- Your full legal name and contact information.
- Identification of the content that was removed and the location where it appeared.
- A statement under penalty of perjury that you have a good-faith belief the content was removed as a result of mistake or misidentification.
- A statement that you consent to the jurisdiction of the federal court in your district and that you will accept service of process from the person who filed the original takedown notice.
- Your physical or electronic signature.
Upon receiving a valid counter-notification, CastProof will forward it to the original complainant. If the complainant does not file a court action within 10 business days, we may restore the removed content.
7. Repeat Infringer Policy
CastProof maintains a strict repeat infringer policy. Consequences escalate as follows:
- First Offense: Content removal, formal warning, and documentation of the violation.
- Second Offense: Content removal, temporary account suspension (minimum 30 days), and review of all prior content generated by the account.
- Third Offense: Permanent account termination, forfeiture of any pending payouts, and potential referral to law enforcement.
CastProof reserves the right to immediately terminate any account involved in egregious or willful violations, regardless of the number of prior offenses.
8. Our Enforcement Commitment to Models
CastProof is built to protect Models. Our enforcement commitment includes:
- Proactive Monitoring. We continuously monitor for unauthorized use of CastProof-generated content across the web.
- Rapid Response. Takedown requests involving Model likeness rights are prioritized and acted upon within 5 business days.
- Legal Support. For cases of significant or repeated misuse, CastProof may provide documentation and support to assist Models in pursuing legal remedies.
- Transparency. Models can view all active licenses and usage requests through their dashboard and will be notified of any enforcement actions taken on their behalf.
9. Designated DMCA Agent
In accordance with the Digital Millennium Copyright Act (17 U.S.C. § 512(c)(2)), CastProof has registered a designated agent with the U.S. Copyright Office to receive notifications of claimed infringement.

10. TAKE IT DOWN Act Compliance
In compliance with the TAKE IT DOWN Act (signed May 2025, enforcement deadline May 2026), CastProof commits to the following:
- 48-Hour Response. Upon receiving a valid report of non-consensual intimate imagery or deepfake content, CastProof will remove or disable access to the reported content within 48 hours.
- Duplicate Detection. CastProof will make reasonable efforts to identify and remove identical copies of reported content across the platform.
- Clear Reporting. A clear, accessible reporting mechanism is available through the in-app takedown flow and via email at dmca@castproof.com.
